Ending a Marriage and Resolving Children's Issues

A Texas divorce generally covers two separate sets of questions. One concerns property and debt, which the court divides in a manner it considers just and right rather than splitting evenly. The other concerns the children, and that part follows a different set of rules entirely.

Texas family law generally uses the terms conservatorship and possession and access instead of custody. Conservatorship covers your rights and responsibilities as a parent, while possession and access covers your parenting schedule. The law usually presumes both parents should be joint managing conservators, which is why a child custody case is often less about who gets the children and more about how decision-making and time are divided. A history of family violence removes that presumption.

Child support is calculated separately, based on the paying parent's monthly net resources. Support and possession stay independent of one another. Withholding payments does not cancel the other parent's time, and denying time does not excuse missed payments.

Prenuptial and Postnuptial Agreements for Dallas and Collin County Couples

Not all family law cases revolve around conflict. A prenuptial or postnuptial agreement lets spouses decide in advance how property, debt, and income would be treated, which can matter enormously when one party owns a business or brings substantial separate property into the marriage.

Texas courts will enforce these agreements, but not automatically. To dispute a prenup or postnup, you must show either that it was not signed voluntarily or that it was unconscionable when signed and that you did not receive fair disclosure of the other's finances, did not waive disclosure, and had no adequate knowledge of those finances.

Protecting Yourself From Family Violence

If you are in danger, the court can act before the other party is even notified. A judge may issue a temporary ex parte protective order based on a sworn application describing the facts and the need for immediate protection.

After a hearing, a protective order generally lasts for the period stated in the order, up to two years. If no period is stated, it runs until the second anniversary of the date it was issued. Longer terms are available in certain circumstances.

Violating a protective order can result in contempt proceedings, and the conduct may also be prosecuted as a separate criminal offense. Family violence findings also affect conservatorship, which is why these two proceedings often need to be handled together rather than separately.

Establishing Legal Parentage for Texas Fathers

When parents are not married at the time of birth, paternity may still need to be legally established unless Texas law already recognizes a presumed father. Establishing parentage is what gives a father standing to seek conservatorship and possession, and what gives the child rights to support, inheritance, and benefits.

Many parents sign an acknowledgment of paternity at the hospital. That document carries the force of a court adjudication, and the window to undo it is narrow. A signatory may rescind it only before the 60th day after it takes effect, or before a related administrative or judicial proceeding begins, whichever comes first. After that period closes, a challenge is limited to fraud, duress, or a material mistake of fact.

That is why paternity disputes are worth resolving before anyone signs rather than after. Fathers' rights cases frequently turn on this step, since a father without established parentage has no legal standing to ask a court for anything regarding his child.

Adding a Child to Your Family

Adoption creates a permanent legal parent-child relationship. Before the court can finalize most adoptions, any parental rights that conflict with the adoption must first be addressed through consent, relinquishment, or termination.

Stepparent, relative, and agency adoptions each follow different procedures. A stepparent adoption may require dealing with the other biological parent's rights, while a relative adoption can involve existing custody or support orders. Careful handling of those issues helps make the final adoption legally secure.
